The Association has adopted the following Rules for the protection and benefit of all members to provide for the safe and sanitary operation of the pool and surrounding facilities. These Rules shall apply to the swimming pool, whirlpools, hot tub, and the pool decking and other property enclosed by the Association’s fence (the “Pool Facilities”). These Rules shall apply to all members, guests, tenants, renters, invitees, and other persons permitted to access the Pool Facilities (the “Users”).
THE USE OF ALL POOL FACILITIES SHALL BE AT YOUR OWN RISK.
1. All Users may only access and utilize the Pool Facilities in a manner consistent with all applicable laws, regulations, posted signs and the Condominium documents, inclusive of these Rules and shall do so at their own risk and sole responsibility. The Association assumes no responsibility for any accident, injury or damage in connection with the use of the Pool Facilities. There shall be NO LIFE GUARD ON DUTY within the Pool Facilities.
2. For good cause, the Association reserves the right to deny any User access to the Pool Facilities as a result of any violation of these Rules, or any other reason to promote the safe and sanitary use of the Pool Facilities.
3. Members may invite guests to accompany them when using the Pool Facilities provided said guests are at all times accompanied by the Member. Members shall be responsible for the conduct of all guests.
4. The capacity of the Pool Facilities, swimming pools, whirlpools and hot tubs is limited. To afford all Members the opportunity to utilize the Pool Facilities, swimming pools, whirlpools and hot tubs, access to the Pool Facilities for all non-Member Users, including without limitation tenants and renters, shall be limited to the number of individuals the applicable unit is permitted to sleep. A violation of this regulation will result in the non-Member User’s immediate removal from the Pool Facilities and a forfeiture of any privilege of utilizing any of the Pool Facilities for the remainder of the stay.
5. Children under twelve (12) years of age accessing or using any portion of the Pool Facilities must be accompanied and supervised by a responsible adult at all times.
6. Accessing and utilizing the Pool Facilities shall only be permitted during the posted hours of operation. In its sole discretion, the Association reserves the right to modify the hours of operation of the Pool Facilities, and/or to close the same from time to time for any reason, including any temporary closure related to inclement weather, operational difficulties and/or maintenance. The initial hours of operation of the Pool Facilities shall be 8:00 AM to 10:00 PM.
7. At all times, persons using any portion of the Pool Facilities shall be appropriately attired.
8. The Association shall not be responsible for the loss, damage or theft of any personal property of any kind within the Pool Facilities.
9. Users shall shower before entering the swimming pools, whirlpools, and/or hot tubs.
10. Pets and animals are not permitted within the Pool Facilities.
11. Running, pushing, wrestling, horseplay, or any conduct causing undue disturbance to other Users is prohibited within the Pool Facilities.
12. Spitting and other unhygienic conduct is strictly prohibited within the Pool Facilities.
13. Abusive and profane language is prohibited within the Pool Facilities.
14. Food and drink shall only be permitted within the Pool Facilities in strict compliance with this Rule. No food or drink shall be permitted within four (4) feet of any swimming pool, whirlpool or hot tub. Extreme care must be taken that absolutely NO GLASS, GLASS BOTTLES or other GLASS CONTAINERS be allowed within the Pool Facilities. Trash and refuse must be placed in the receptacles provided and/or removed from the Pool Facilities. Anyone who hosts or participates in serving or consuming food or beverages within the Pool Facilities will be held strictly responsible for cleaning up after themselves and their guests.
15. Diapers are prohibited within the swimming pools, whirlpools, and hot tubs. Notwithstanding the foregoing, children may wear approved swim diapers provided said diapers do not create any unsanitary condition.
16. Smoking is prohibited within the Pool Facilities. However, in the future the Board of Directors may, in its sole discretion, designate a certain portion(s) of the Pool Facilities as a “Smoking Area(s).”
17. DIVING IN TO ANY SWIMMING POOL, WHIRLPOOL OR HOT TUB IS STRICTLY PROHIBITTED.
18. Skateboards, bicycles, scooters and other similar items are prohibited within the Pool Facilities.
19. Any User who does not fully understand any posted rules or understand the proper use of the Pool Facilities shall not use such facility without first receiving instruction and/or direction from an officer of the Association or a representative of the Management Company.
20. Spa Guests accessing or utilizing the Pool Facilities will be required to sign acknowledging their understanding and agreement to adhere to all Pool Rules, prior to being permitted access to the same.
21. The Association reserves the right to modify or amend these Rules in its sole discretion.
22. As the capacity of the Pool Facilities is limited, the Board of Directors and Pool and Property Committee of the Association have found that the right of renters and tenants to access and use the Pool Facilities should be reasonably limited to provide for the use and enjoyment of the pool by all owners, guests, renters and tenants. Such limited access will also serve to preserve the condition and value of the Pool Facilities and protect against the misuse and abuse of the Pool Facilities by persons with no ownership interest therein. Based on those findings, occupancy and use
of the Pool Facilities shall be limited as follows except with express consent of the Board of Directors:
1. At any given time, only four (4) persons shall be permitted access to and use of the Pool Facilities in connection with the rental of any one (1) bedroom Unit;
2. At any given time, only six (6) persons shall be permitted access to and use of the Pool Facilities in connection with the rental of any two (2) bedroom Unit;
3. At any given time, only eight (8) persons shall be permitted access to and use of the Pool Facilities in connection with the rental of any three (3) bedroom Unit; and 4. At any given time, only ten (10) persons shall be permitted access to and use of the Pool Facilities in connection with the rental of any four (4) bedroom Unit.
The foregoing restriction limiting access and use shall only be applicable to units being rented or leased and shall not apply to any owner occupying his or her Unit.
